What does Mediation mean?
Mediation is the process through which an objective third party (the mediator), meets jointly with you and the other party to reach a negotiated settlement agreement. Mediation is based on the win-win principal and requires give and take by both parties.

 

How do I know if Mediation is right for me?

Mediation is only effective if you are able to communicate effectively with the opposing party.  If you cannot sit down together and discuss settlement openly and agreeably, you are not a candidate for Mediation.

How is the mediator’s role different from that of an attorney?

A mediator does not advocate for either party.  The mediator’s role is to assist both parties in reaching a mutually satisfactory settlement agreement. 

Is Mediation less costly than litigation?

Mediation may be less costly than litigation, if both parties come into the mediation process with willingness to give and take.  If, in your opinion, the process you would be starting would be more contentious, an attorney who can represent you exclusively may be your more appropriate choice.
