What does litigation mean?
In family court, litigation is the process whereby each party presents their argument to the Court and the Judge renders a final decision.

 

Are all issues argued before a Judge?

No.  Many times, the parties only argue about one aspect of a family law case, such as support or custody, and settle the rest of their case out of court.  For example, the parties may agree on how to divide the household furniture, but disagree as to the amount of support.

Do you have to have an attorney represent you in Court?

No. You do not have to have an attorney, you can represent yourself.  However, you should be aware that the Court holds a person representing themselves to the same standard of knowledge about courtroom behavior, the local rules and family law as an attorney would be held.  

If I represent myself, do I still need to meet with an attorney?

You should always consider meeting with an attorney to find out about your rights and responsibilities.  It is also important to have any marital settlement agreement reviewed by an attorney before you sign it, to make sure your rights are protected.
